The JLH ProjectDietary Supplements Under Attack Again: New York’s Attorney General Eric T. Schneiderman, (NYAG) launched what the Council for Responsible Nutrition has termed a sting operation and publicity stunt on dietary supplement major retail outlets – Target, GNC, Walgreens and Walmart. The NYAG claims to have conducted independent DNA barcode testing on top selling products purchased at these outlets and further claims that the herbs listed on the labels were not found in the products. Subpoenas and cease and desist letters were issued after he publicized his findings. What the NYAG has not done is release the findings for independent evaluation.

Numerous botanical experts have stated that the testing method the NYAG states was used is in fact invalid for using on finished botanical products. Many industry officials are concerned because this state legal activity, which of course got national media attention, is short on facts. There was a failure on the NYAG’s part to release information confirming whether the amounts of supposed contaminants such as gluten, beans, rice, were trace, minute, or in amounts that exceeded the federal limits.   The New York Times has published the cease and desist letters sent to companies at http://www.nytimes.com/interactive/2015/02/02/health/herbal_supplement_letters.html

Quality Assurance is required under federal FDA cGMP guidelines as stipulated in federal law. If companies are marketing adulterated products including products that do not contain the herbs on the label, then the NYAG is well within his purview to request these products not be sold in his state. Until and unless there is sunlight in the process, and the data is released for review, we cannot be sure whether the NYAG’s actions are justified, or simply a publicity stunt, setting the stage for legislators to attempt a challenge to the existing federal laws on dietary supplements.

Update on CDC Whistleblower: One member of Congress, Representative Bill Posey, is in discussion with the whistleblower and hopes to get a hearing in Congress to bring these issues into the public forum and on the record this spring. In the meantime, families are continuing to engage in educating the public in social media and advocating to their legislators to seek the truth and make it public. More to follow.

 

Health Freedom Under Attack in 2015: Public health officials seem to be attacking health freedom at both state and federal levels.

 

Medical Kidnapping Anyone who spends time on social media is likely seeing an increase in the number of stories of parents who are having their children taken from them by state governments for issues such as seeking second opinions, a desire to use or incorporate complementary therapies, or seeking to move a child from one hospital to another. Vaccination Policies: The recommended schedule for both children and adults is set by the Advisory Committee on Immunization Practices (ACIP) managed by the Centers for Disease Control and Prevention (CDC). Since the Clinton Administration, federal policies require that all families receiving welfare and all other federal assistance except housing assistance must prove their children’s vaccines are up to date. State legislative bodies determine what vaccines will be mandatory for children to attend school. All states provide medical exemptions, most provide religious exemptions and a handful also provide for philosophical exemptions. The public health is capitalizing upon the Disney World measles outbreak to call for the elimination of philosophical exemptions, and vaccine industry representative, Dr. Paul Offit has a soon to be released book he is promoting calling for the end of religious exemptions as well. He bases his opinion on a single incidence in his medical career almost a quarter century ago. This is the same doctor who collaborated with the infamous Quackbusters to produce a book attacking alternative therapies.

 

TV Storyline Manipulation: The CDC and numerous other federal agencies utilize taxpayer dollars to stimulate interest in story lines in Hollywood for television shows. The CDC may be the most involved in this Hollywood liaison (http://www.cdc.gov/healthcommunication/ToolsTemplates/EntertainmentEd/). What this means is that television shows are working in collaboration with the federal government to ‘change the hearts and minds’ of the American public through subtle messaging and at times outright misinformation on issues such as the autism-vaccine connection, and lately complementary therapies. We have observed in the span of one week, two popular TV shows had story lines what included a negative focus on alternative therapies. Additionally, news shows and talk show hosts take their talking points directly from federal authorities. CDC provides press kits for media at http://www.cdc.gov/media/index.html. The NIH does the same thing.

Senate approves U.S. Surgeon General Nomination: The Senate approved President Obama’s nomination of Dr. Vivek Murthy to serve as U.S. surgeon general, despite opposition from some Republicans and Democrats over his support for gun control. Murthy, 37, is a physician at Boston’s Brigham and Women’s Hospital and instructor at Harvard Medical School. He’s a co-founder of Doctors for America, a group that pushes for affordable health care and supports Obama’s health care law. Sen. John Barrasso, R-Wyo., said most of Murthy’s career has been spent as an activist focused on gun control and other political issues, rather than on treating patients. “Americans don’t want a surgeon general who might use this position of trust to promote his own personal campaign against the Second Amendment of the Constitution,” Barrasso said. Supporters said Murthy is well-qualified and noted his promise not to use the position as a bully pulpit for gun control. The nation has been without a Senate-confirmed surgeon general since July 2013. The surgeon general does not set policy but is an advocate for the people’s health.

School Meal Standards: A massive year-end spending bill released Tuesday doesn’t allow schools to opt out of healthier school meal standards but it would ease standards that require more whole grains in school foods. The bill also would put off rules to make school meals less salty, putting off lower sodium standards that were supposed to go into effect in 2017. The spending bill is expected to become law before the end of the year. The bill says the government cannot require the 2017 sodium levels “until the latest scientific research establishes the reduction is beneficial for children.”

On other food issues, the spending bill would allow fresh white potatoes to be part of the federal Women, Infants and Children nutrition program. The Agriculture Department doesn’t currently allow them, even though it allows other fruits and vegetables, because it says people already eat enough white potatoes.

 

ObamaCare/Affordable Care Act: A strange thing has happened on Capitol Hill. Senior Democrats who were vital in writing and promoting ObamaCare appear to be having a change of heart. “Unfortunately, Democrats blew the opportunity the American people gave them,” Senator Chuck Schumer, D-NY, told an audience at the National Press Club last week. “We took their mandate and put all of our focus on the wrong problem — health care reform.”  Schumer punctuated his criticism with the disclaimer that health care reform was nevertheless an important issue; it just should have been a bit farther down on the to-do list. “Americans were crying out for the end to the recession, for better wages and more jobs, not changes in health care,” he said. Sen. Tom Harkin, D-Iowa, the retiring chairman of the Senate health panel and who also helped write the law, told The Hill newspaper that ObamaCare didn’t go far enough, arguing that the party should have pushed harder for a government-run, single-payer system while it had a filibuster-proof majority — or dropped it altogether. “We had the power to do it in a way that would have simplified healthcare, made it more efficient and made it less costly and we didn’t do it,” Harkin said, according to the Hill. “So I look back and say we should have either done it the correct way or not done anything at all.” These remarks are striking, coming from some of Capitol Hill’s most senior and influential Democrats.

 

Medical Marijuana Protection: Congress Passes Historic Medical Marijuana Protections in Spending Bill: Congress dealt a historic blow to the United States’ war on drugs with the passage of the federal spending bill, which contains protections for medical marijuana and industrial hemp operations in 23 states where they are legal. The bill includes an amendment that prohibits the Department of Justice from using funds to go after state-legal medical cannabis programs. If signed into law, the bill will bring the federal government one step closer to ending raids on medical marijuana dispensaries, as well as stopping arrests of individuals involved with pot businesses that are complying with state law. The bill protects medical marijuana programs in states that have legalized marijuana for medical purposes, plus 11 additional states that have legalized CBD oils, a non-psychoactive ingredient in marijuana shown to be beneficial in some severe cases of epilepsy. Under the Controlled Substances Act, marijuana is still classified as a Schedule I substance with “no currently accepted medical use,” alongside heroin and LSD. Since that doesn’t change with the passage of the omnibus package, it’s not entirely clear how the protections will work in practice.

NSP Enters China

On June 25, 2014, Nature’s Sunshine’s CEO, Greg Probert, signed a contract with Fusun Pharma, a $1.5 billion leading healthcare company in the People’s Republic of China, to form a joint venture to market and distribute Nature’s Sunshine and Synergy products in China. Mr. Probert will be CEO of this joint venture. This joint venture is the first of its kind between a U.S. company and a Chinese company for direct selling products in China. NSP products will now be available in 49 countries.
One unique feature of the market in China with regard to direct selling is that it is a “closed” market and does not allow up-line commissions to be paid outside of China. NSP products will be sold at Retail; Synergy products will sell at Distributor/Wholesale cost, according to a marketing plan to be developed.
Now is the prime time to invest in NSP stock. Its cost per share has already grown and should continue to escalate. It is anticipated that the closing on this venture will occur in the third quarter of 2014, after all the customary closing conditions and regulatory approvals are met and received.
